Adverse Possession Claims

Adverse Possession is a process whereby a person in occupation of an area of land owned by someone else acquires valid title to it. Certain criteria have to be met for a valid adverse possession claim to succeed.

Adverse Possession is evidenced by demonstrating actual possession and exclusive enjoyment of the land. Generally, if you have been in occupation of an area of land that you do not own, rent or have permission to use in excess of 12 years without any objection from the registered owner, then you may be able to claim “adverse possession” of the land.
